Once again, undocumented students are under attack in the higher education system due to a court ruling that has determined AB 540 to be in conflict with federal law.

AB 540, passed in October 2001, allows undocumented students who have resided in California and attended a California high school to pay in-state tuition. Its passage was a victory for immigrant communities in the states, and provided a space for further proposals, such as the DREAM Act (which sought to provide financial aid for AB 540 recipients).

Earlier this year also Assemblyman Chuck Devore (R-Irvine) introduced AB 1758 to the Assembly Education Committee. This bill is proposed to repeal AB 540 if it advances.
